1. Provider identification

These terms and conditions govern the contracting of services offered through the website sincronia.agency, owned by:

2. Object and scope of application

These general terms and conditions govern the contractual relationship between Roberto Carrera Santa María (hereinafter, "the provider") and the client (individual or legal entity) contracting any of the services offered on sincronia.agency: web design and development, SEO positioning, WordPress maintenance, custom application development and hosting services.

The contracting of any service implies full and unreserved acceptance of these conditions. The client declares to be of legal age and have legal capacity to contract.

3. Service information and pricing

The services offered, along with their prices, features and timelines, are detailed on the specific pages of each service:

• WordPress maintenance — from €35/month
• WordPress development — from €800/project
• Web application development — from €3,500/project
• SEO positioning — from €300/month
• Strata website maintenance — The maintenance scope is confirmed in the proposal.

10% off maintenance only while a paid CMS licence and maintenance are active for the same website. Cannot be combined with other promotions. The Free plan does not qualify. The licence is charged separately and its price does not change. When the paid licence ends, maintenance returns to its base rate. The proposal confirms availability, scope and terms; this information does not activate automatic billing.

All prices are stated in euros (€) and include applicable VAT, unless expressly stated otherwise. Prices may be revised, but the change will not affect already contracted services.

4. Contracting process

1. The client requests a quote through the contact form or by email.
2. The provider sends a personalised proposal with scope, price, timelines and particular conditions.
3. The client accepts the proposal by written confirmation (email or document signature) and, where applicable, makes the first payment according to the agreed payment method.
4. Once acceptance and the initial payment are received, the contract is considered perfected and the service provision begins.

5. Payment method

The usual payment methods are:

• Maintenance and SEO services (monthly): direct debit or card at the start of each monthly period.
• Development services (per project): 40% upon quote acceptance (start), 30% at project mid-point and 30% upon final delivery.

The particular conditions of each project (amounts, timelines and payment method) will be detailed in the personalised proposal and will prevail over these general conditions in case of discrepancy.

6. Delivery timelines

Delivery timelines are established in the personalised proposal for each project. The provider commits to meeting the agreed timelines provided the client supplies materials, access and approvals in a timely manner. Lack of response from the client for more than 30 calendar days may suspend the timeline count.

7. Right of withdrawal

In accordance with article 103 of the Spanish General Law for the Defence of Consumers and Users (Royal Legislative Decree 1/2007), the client who is a consumer (individual acting for purposes unrelated to their professional activity) has a period of 14 calendar days to withdraw from the contract from the date of its conclusion, without any penalty.

However, the right of withdrawal does not apply once the service has been fully performed, or when its execution has begun with the consumer's express consent and acknowledgement that they lose their right of withdrawal. This is common in web development projects, where the client approves the start of work.

To exercise the right of withdrawal, the client must notify the provider in writing (email to contacto@sincronia.agency) within the indicated period.

8. Legal warranty

The provider guarantees the conformity of services with the specifications agreed in the proposal. Web development services include a warranty period of 30 calendar days from delivery, during which functional defects directly attributable to the provider's work will be corrected free of charge. Defects arising from misuse, modifications by third parties, updates to external platforms (WordPress, plugins, themes) or lack of adequate maintenance are excluded from this warranty.

9. Client obligations

The client commits to:

• Provide truthful and complete information about the project.
• Facilitate the necessary access (credentials, hosting, domains, content) in a timely manner.
• Review and approve deliveries within agreed timelines.
• Make payments on the established dates.
• Not use the provider's services for unlawful activities or activities that infringe third-party rights.

10. Intellectual property

Project deliverables (design, code, content) are transferred to the client exclusively once full payment of the project is completed. Until then, the provider retains all intellectual property rights over them.

The provider reserves the right to mention the completed project as part of its portfolio and commercial references, unless expressly agreed otherwise.

11. Data protection

The processing of the client's personal data is governed by the website's Privacy Policy, which forms an integral part of these conditions.

12. Limitation of liability

The provider will not be liable for damages arising from:

• Force majeure (power cuts, internet provider outages, mass server attacks, etc.).
• Improper use of the services by the client or third parties.
• Loss of data or content due to lack of backups by the client.
• Third-party software updates that affect the project's operation.

In any case, the provider's maximum liability is limited to the total amount paid by the client for the contracted service in the preceding 12 months.

13. Commercial communications

The provider may send the client commercial communications about its own services, provided the client has given consent or there is a prior contractual relationship. The client may object at any time by sending a request to contacto@sincronia.agency.

14. Contract termination

Either party may terminate the contract in the following cases:

• Mutual agreement between the parties.
• Serious breach of contractual obligations, upon prior written notice with a 15-day period to remedy.
• For monthly services (maintenance and SEO), the client may cancel the service with 30 calendar days' notice.

In the event of termination, the client will pay for the services effectively provided up to the date of termination.

15. Modifications

The provider reserves the right to modify these conditions to adapt them to legislative or jurisprudential developments. Modifications will be applicable from their publication on the website and will be communicated to clients with contracts in force.

16. Applicable law and jurisdiction

These conditions are governed by applicable Spanish and European legislation. For the resolution of any disputes that may arise from their interpretation or application:

• If the client is a consumer, the parties submit to the Courts and Tribunals of the consumer's domicile.
• In other cases, the parties expressly submit to the Courts and Tribunals of the city of Tarragona, waiving any other jurisdiction that may apply.

17. Online dispute resolution platform

In compliance with Regulation (EU) 524/2013, the client is informed of the existence of the European Commission's online dispute resolution platform, accessible at ec.europa.eu/consumers/odr.
